Spouse or Partner Sponsorship

1 Sponsor Eligibility:

  • Must be 18 years of age or older
  • Be a Canadian, a permanent resident of Canada, or a registered Indian
  • Resides in Canada (a Canadian citizen living outside Canada can sponsor a relative provided that the sponsor plans to live in Canada when the sponsored person becomes a permanent resident.)
  • Sign a sponsorship agreement with the sponsored relative committing to provide financial support if necessary
  • Sign an undertaking (for spouse or partner the duration is 3 years; for dependent child the duration is 10 years or until the child turns 25 -whichever comes first, commencing on the day the sponsored person becomes a permanent resident)
  • Be not under a removal order or detained in jail, prison, or penitentiary
  • Be not convicted for committing or attempting to commit a violent offence punishable by a maximum term of imprisonment of at least 10 years, unless a pardon or acquittal is received or 5 years have elapsed since the completion of an imposed sentence
  • Be not an undischarged bankrupt or in default of repayment of any debt
  • Be not in receipt of social assistance for a reason other than disability
  • Be not in a bigamous or polygamous relationship
  • Meet low income cut-off (LICO) requirement for the past 12 months if the spouse or partner has a dependent child who also has a dependent child of their own.

2 Key Notes:

  • It's important to prove that the spousal relationship is genuine.
  • Applicants must declare all family members when applying for permanent residence.

A non-accompanying dependent child who was not declared or examined would not be eligible to be sponsored by the applicant in the future as a member of the family class because they would be deemed to be excluded.

  • Misrepresentation of a material fact may result in the applicant being inadmissible.
  • A person who became a permanent resident after being sponsored as a spouse or partner may not sponsor a new spouse or partner within 5 years of becoming a permanent resident or Canadian citizen.
  • Length of the undertaking is 3 years from the day the sponsored spouse or partner becomes a permanent resident. The sponsor may not sponsor a new spouse or partner until 3 years after the previously sponsored spouse or partner became a permanent resident.

3 Eligibility of the Sponsored Spouse or Partner:

  • Must be 18 years of age or older
  • Must not be inadmissible
  • Meet medical examination requirement
  • Have genuine relationship with the sponsor
  • Be not in a bigamous or polygamous relationship

4 Application Process:

  • Receiving professional advice and tailored immigration strategies from Aladdin

  • Submitting complete application package to IRCC
  • Receiving work permit for spouse or partner
  • Sponsor eligibility review and application processing by IRCC
  • Receiving Confirmation of Permanent Residence (COPR) and PR Visa
  • Landing in Canada and receiving permanent resident card

Government Fees:

  • Application Fees: $1,040 (incl. $75 sponsorship fee and $475 principal applicant processing fee and $490 right of permanent resident fee); dependent children: $150/per child.
  • Spouse or Partner Work Permit: $255
  • Biometrics Fees: Per Person: $85; Family (2 or more): $170
  • Third-party fees: medical exams, police certificates, language testing, notary, translation, delivery and postage, etc.
  • Aladdin Immigration fees (excluding any government or third party charges)
